Regulations
The KidneyUp app was created solely to help users self-monitor the treatment process and monitor the course of kidney disease. The KidneyUp app, is NOT a medical device, DOES NOT replace the advice of doctors and specialists, DOES NOT make a diagnosis and DOES NOT analyze the medications taken. The KidneyUp app helps to implement the recommendations of doctors and, if the user takes advantage of such functionality, to monitor the physical and psychological well-being of the user in particular by monitoring general body parameters such as j temperature, blood pressure, fluid balance or heart rate.

- Definitions
- Application - a mobile device application called KidneyUp made available to the User by the Operator, the purpose of which is to support the Dedicated User in self-monitoring of the treatment process and monitoring of the course of kidney disease, and - if the Dedicated User makes use of such functionality - to monitor the Dedicated User's physical and psychological well-being, in particular by monitoring general body parameters such as j temperature, blood pressure, fluid balance or heart rate.
- Dedicated User Assistant - functionality of the Application, based on artificial intelligence systems, involving constant interaction between the Dedicated User and the Dedicated User Assistant.
- Medical Data - medical data relating to the Dedicated User that was either entered into the Application independently by the Dedicated User or was retrieved by the Application using the Dedicated User's Measurement Device.
- Form - an electronic form, available in the Application, used to create an Account in the Application.
- Civil Code - the law of April 23, 1964 Civil Code.
- Consumer - any natural person making a legal transaction with the Operator that is not directly related to his commercial, business, craft or freelance activities.
- Account - a space made available to the User within the Application, where the User's data is collected and where the User gains access to the functionality of the Application.
- Operator - a company under the name of KIDNEYUP spółka z ograniczoną odpowiedzialnością with its registered office in Olsztyn, ul. Władysława Trylińskiego nr 14 lok. 13, 10-683 Olsztyn, entered in the Register of Entrepreneurs maintained by the District Court in Olsztyn, VIII Commercial Department of the National Court Register, KRS: 0000962805, REGON: 521570582, NIP: 739396599, share capital: PLN 5,000.00, making the Application available to Users.
- Guardian - a natural person, being a Consumer, who is 18 years of age or older, with full legal capacity - who, after reading and accepting the provisions of the Regulations, has completed the registration process in the Application, resulting in the possession of an active account in the Application and:
- to which a Dedicated User, who is not a Dependent, has provided access within the Application to view all or a selection of the Dedicated User's Medical Data, or
- who, being authorized to do so by law, creates a Dedicated User Account for a Dependent and has access to all Medical Data of a Dedicated User who is a Dependent.
- Subscription Fee - the total monthly fee for the use of the Application in the Full Package or the Guardian Package.
- Dependent - a User, who is a Consumer, without legal capacity or with limited legal capacity (including but not limited to a person under 18 years of age), on behalf of whom the Guardian referred to in Section 1.9.2 has agreed to conclude the Agreement, accept the Terms and Conditions and create an Account.
- Package - the range of functionalities of the Application to which the User has access.
- Basic package - access to a limited amount of functionality of the Application.
- Full package - access to all functionalities of the Application.
- Caregiver Package - access to all features of the Caregiver Application.
- Regulations - these regulations of the Application.
- Agreement - an agreement for the provision of Services under the terms of the Regulations, concluded, between the User and the Operator.
- Services - services provided electronically by the Operator, consisting of providing access to the functionality of the Application, through the telecommunication system used by the User.
- User:
1.20.1. a natural person, being a Consumer, who is 18 years of age or older, with full legal capacity - who, after reading and accepting the provisions of the Regulations, has completed the process of registration in the Application, which results in having an active account in the Application;
1.20.2. - Dependent on whose behalf acceptance of the provisions of the Terms and Conditions was made by the Guardian referred to in Section 1.9.2., resulting in the possession of an active account in the Application.
- Dedicated User - a User who can, under the selected Package, use the functionality of the Application and whose Medical Data is saved and stored in the Application.
- Device - the mobile device on which the Application is installed.
- Measuring Device - a device that allows the Dedicated User's information or results to be directly downloaded and placed in the Application, such as. wrist-band, smart-watch or glucometer, which can take the form of:
1.22.1. an external device that transmits information directly to the Application;
1.22.2. an external device transmitting information to an application dedicated to that device, which application then transmits that information to the Application;
1.22.3. applications other than the Application installed on the Device that transmit information directly to the Application.
- Electronic Services Act - the Act of July 18, 2002 on the provision of electronic services.
- Consumer Rights Act - the law of May 30, 2014 on consumer rights.
- General provisions
- All persons using the Application may at any time, without charge, read the Terms and Conditions available in the Google Play store (for Android), the App Store (for iOS) and on the Operator's website. The Terms and Conditions may also be downloaded and printed free of charge from the Operator's website.
- The Regulations set out the terms and conditions for the provision of Services by the Operator, including the use of the Application.
- The Regulations constitute the rules and regulations within the meaning of min. 8. of the Act on the provision of electronic services.
- The Application is intended for Users, who may only be natural persons. Users may use the Services, provided through the Application, only for private purposes.
- The sole purpose of the Application is to support Users in self-monitoring the treatment process and supervising the course of kidney disease. The Application, is NOT a medical device, DOES NOT replace the advice of doctors and specialists, DOES NOT make a diagnosis and DOES NOT analyze the medications taken. The Application assists in the implementation of doctors' recommendations and, if the Dedicated User takes advantage of such functionality, monitors the Dedicated User's physical and psychological well-being, in particular by monitoring general body parameters available through the Application, such as temperature, blood pressure, fluid balance or heart rate.
- The Application is not and under no circumstances can the Application be considered as a tool for diagnosing specific cases of diseases.
- The application does not and cannot be considered a substitute for direct examination by a doctor.
- The application is not a tool and cannot be used as a tool to make a self-diagnosis and implement self-treatment - it only complements and supports the Dedicated User's maintenance of possible good health.
- The Operator reserves the right to include advertising content or links to such content in the Application. The User acknowledges that clicking on such a link or opening such content may result in being charged a set fee by the telecommunications operator or Internet service provider.
- The Operator has no control over the accuracy or correctness of the content or information provided or used by the Users, and therefore the User acknowledges that only the provision of correct and complete data will allow the Operator to duly provide the Services and use all functionalities of the Application.
- The Operator, in order to ensure the proper functioning of the Application and the Operator's efforts to ensure the highest quality of services provided, may communicate with Users both through the Application, but also by e-mail, to the User's address associated with his Account.
- The use of the Application is subject to the terms and conditions set forth in the Regulations. By using the Application, the User agrees to the terms and conditions set forth in the Terms and Conditions. If the User does not accept any provision of the Terms and Conditions, he/she may not use the Application. In the case of Users who are Dependent Persons, any statements and assurances contained in the Terms and Conditions and made by Users shall be deemed valid and effectively made by the Dependent Persons' Guardians.
- It is forbidden for Users to disseminate, within or through the Application, unlawful content, inconsistent with the factual or legal status, or violating the rights of third parties, in particular violating the personal rights of other Users.
- You may not sell, transfer or assign your right to use the Application, to a third party.
- User Account
- Use of the Application is possible only after registration of an Account, by completing the Form and accepting the Terms and Conditions.
- Creating an Account is free of charge and voluntary, however, it is necessary to use the functionality of the Application.
- Account registration is possible:
- via the User's Google account;
- Through the User's Facebook account;
- via your Apple account
- by confirming the creation of the Account sent to the e-mail address indicated by the User.
- In the case of the User's use of the Account registration using clauses 3.3.1. - 3.3.3. - the Application uses the data, previously provided by the User to these services, solely for the purpose of authorizing the User's identity. The User's use of logging in through the aforementioned services does not result in the transfer to these entities of any of the User's data contained in the Application, in particular, these entities will not have any access to the Medical Data.
- The contract for the provision of electronic services for the use of an Account, for a User who is not a Dependent, is concluded upon the creation of an Account by a given User, after the User's prior acceptance of the Terms and Conditions.
- An Account for a Dependent is created by a User who is a Guardian and who has previously created a Guardian Account on his/her Device. In this case, the Caregiver sends a link to the Dependent's email address with the data for downloading the Application to the Dependent's Device. The Dependent activates the Application on his/her Device, without further acceptance of the Terms and Conditions.
- Each User may have only one Account, and within one Account the User may switch between the Dedicated User profile and the Guardian profile. A User may be a Guardian of more than one Dedicated User.
- It is forbidden to share passwords or allow third parties to use the Application on behalf of the User.
- Technical requirements
- In order to properly use the Application, it is necessary:
- ICT device with Internet access and a camera;
- correctly configured web browser that supports javascript and cookies;
- Android system - version 7.0 or higher, or i-S - version 15 or higher;
- active electronic mail (e-mail) account;
- phone number.
- The use of the Application requires Internet access, and you may incur network access costs in accordance with your carrier's tariffs.
- The Operator stipulates that the use of the Application may involve standard risks associated with the use of the Internet. In order to avoid the risks mentioned above, the Operator recommends:
- Use of antivirus software and firewall applications;
- keep the software you use up to date (automatic updates recommended);
- avoid untrustworthy websites, as well as not receiving Internet mail from unknown senders.
- The Operator shall make reasonable efforts to ensure uninterrupted operation of the Application. In an effort to ensure a high quality of service and efficient functioning of the Application, the Operator shall have the right to make interruptions in the functioning of the Application. The Operator shall endeavor to make technical interruptions during the night hours (22-6).
- In order to properly use the Application, it is necessary:
- Services available to the Dedicated User under the Application
- The Dedicated User within the Application has the opportunity to use the following Services in particular:
- Notification and reminder services;
- Dedicated User Assistant Services;
- Data collection services using Measuring Devices;
- Sugar monitoring services;
- Dedicated User Health Record Maintenance Services;
- Services covering guide;
- Drug database access services;
- Services for storing and sharing your health information;
- Alarm services;
- Online store access services;
- Calendar of appointments and examinations.
- The notification and reminder service includes the display on the screen of the Dedicated User Device, in particular:
- information about the current state of his/her health, based on the data provided by the Dedicated User's Measurement Devices;
- Information on fluid balance - at the beginning and end of the day;
- medication reminders;
- Requests to supplement weight data - for dialysis patients;
- reminders about upcoming tests and appointments;
- dietary recommendations and recommendations;
- a summary of the day, including information on individual parameters registered by the Application.n. such as physical activity;
- information about the calories that can be consumed on a given day.
- The self-learning Dedicated User Assistant service consists of an interactive exchange of information between the Dedicated User and the Dedicated User Assistant, equipped with artificial intelligence algorithms, by asking the Dedicated User questions. Based on the questions asked by the Dedicated User Assistant and the answers provided by the Dedicated User, the Dedicated User Assistant tries to read the Dedicated User's well-being.
- The service of data collection using Measuring Devices includes, in particular:
- The ability to connect the Application to a Measuring Device that collects and transmits to the Application data regarding the Dedicated User, such as heart rate, temperature, ECG, saturation, blood pressure, sugar, and other data provided by the Dedicated User;
- reminders and recommendations for connecting the Application to the Measuring Device.
- The sugar monitoring service, once the Application is connected to a Measuring Device in the form of a glucometer - includes, in particular:
- Monitoring blood sugar results;
- Recommending the maintenance of a Dedicated Diabetic Diary by the User in case the collected data indicates such action to be reasonable;
- Information about the doses and types of insulin taken.
- The service for the maintenance of the Dedicated User's health record, includes in particular:
- Maintenance of the Dedicated User's health card;
- in the Dedicated User's health card is the ability to include and subgroup, among other things, the following information:
- personal characteristics of the Dedicated User;
- kidney condition;
- registered research;
- comorbidities;
- treatment information;
- transplants;
- past surgeries and treatments;
- supervision of medications taken;
- Creating weekly and monthly statements in terms of medications taken.
- medicines taken;
- dialysis;
- Concerning doctor's care in connection with comorbidities
- all other Medical Data entered into the Application or made available by the Dedicated User in the Application.
- The service, which includes a handbook, includes in particular:
- The drug database access service includes, in particular:
- The possibility of downloading to the Application an external database of drugs updated regularly;
- Search for drugs by phrase and by scanning a QR and/or barcode;
- presentation of available information about the drug.
- The ability to add medications to a medication schedule.
- The service of storing and providing access to the Dedicated User's health information includes, in particular:
- The ability to import the Dedicated User's medical data into the Application;
- The ability to manually enter Medical Data;
- The ability to make the Dedicated User's Medical Data available to the Caregiver;
- Reminders or recommendations for conducting research;
- Automatic reading of test results from photos;
- The ability to download Medical Data from the Application and save it on the Device in the format: PDF, JPG and PNG. .
- The alert service includes monitoring by the Application of the parameters specified by the Dedicated User regarding Medical Data. In the case of Dedicated Users, they independently specify the reference data that the Application monitors. In the event that the Application - based on data from the Measuring Device or entered by the Dedicated User - registers results that do not fall within the reference data, it will activate an alarm causing the Dedicated User to confirm that he/she has read the data. The custodian of the Dedicated User, who is not a Dependent, shall receive such an alarm only if the Dedicated User has made such an option available within the Application.
- The Store access service is detailed in the Store Terms and Conditions available at [*****].
- The drug database access service includes, in particular:
- The Dedicated User within the Application has the opportunity to use the following Services in particular:
- Services available to the Caregiver within the Application
- The Guardian of a Dedicated User, who is not a Dependent, within the Application has the opportunity to use the following Services in particular:
- services to access the Dedicated User's Medical Data - for the period and to the extent that the Dedicated User has consented to such access;
- alarm service, in the event that the Dedicated User's Measuring Equipment reads parameters that deviate from the reference values established by the Dedicated User - for the period and to the extent that the Dedicated User has given its consent to transmit the alarm;
- services to access notifications and reminders provided by the Application to the Dedicated User and the Dedicated User's response (confirmation of execution) or lack thereof - for the period and to the extent that the Dedicated User has consented to the provision of such information.
- The Guardian of a Dedicated User, who is a Dependent, within the Application has the opportunity to use the following Services in particular:
- services to access all the Dedicated User's Medical Data;
- alarm service, in case the Dedicated User's Measuring Equipment reads parameters that deviate from the reference values established by the Dedicated User;
- services to access notifications and reminders provided by the Application to the Dedicated User and the response (confirmation of execution) or lack thereof of the Dedicated User.
- The Guardian of a Dedicated User who is not a Dependent shall have read-only access to the Medical Data, i.e. the Guardian may neither download nor save the Dedicated User's Medical Data.
- A Guardian may have access to the Medical Data of several Dedicated Users, depending on the consents granted by these Dedicated Users or the number of Dependents assigned to the Guardian.
- The Guardian may also be a Dedicated User, in which case Section 5 of the Regulations applies.
- The Guardian of a Dedicated User, who is not a Dependent, within the Application has the opportunity to use the following Services in particular:
- Medical data
- Confidentiality of Medical Data is a top priority for the Operator in the operation of the Application. Accordingly, all Medical Data is stored by the Operator using encryption mechanisms that prevent it from being read by third parties. Reading of Medical Data is possible only on the device of the Dedicated User and the Guardian having access to the Dedicated User's Medical Data, in accordance with the Regulations.
- The Dedicated User, who is not a Dependent, and the Dependent's Guardian are the sole disposers of the Dedicated User's Medical Data. This means that only these entities decide whether to share the Medical Data with other entities.
- A Dedicated User who is not a Dependent and a Dependent's Guardian may also download Medical Data to their own Device and thereby - at their own risk and responsibility - make it available to third parties outside the Application.
- Detailed information regarding the processing of Users' personal data, including Medical Data, is available in the Application's privacy policy available at: [****]
- Incentive System for Dedicated Users
- The Application, analyzing the Dedicated User's implementation of the l.in.nia procedure (such as regularity of taking medications, amount of water consumed, etc.), may award intangible incentives to Dedicated Users in the form of medals, diplomas or badges. In this way, the Dedicated User will know that his or her behavior is in line with the recommendations he or she has received from the doctor, if he or she has correctly entered these recommendations into the Application.
- Packages and trial period
- The use of the Application can be made under the following Packages:
- Basic Package - including access to the following functionalities of the Application:

- Full package - including access to all functionalities of the Application;
- Caregiver Package - including access to all features of the Caregiver Application.
- Basic Package - including access to the following functionalities of the Application:
- For a period of 7 days from the date of creating an Account, the User may use the Application free of charge within the Full Package.
- After 7 days from the date of creation of the Account, access to the Application transforms into access under the Basic Package.
- In order to change access to the Application to access under the Full Package or the Guardian Package, the User is required to pay the Subscription Fee.
- The use of the Application can be made under the following Packages:
- Charges
- The use of the Application under the Basic Package is free of charge.
- Use of the Application under the Full Package requires the User to pay the Subscription Fee, in accordance with the price list provided at [****].
- Use of the Application under the Guardian Package requires the User to pay the Subscription Fee in accordance with the price list provided at [****].
- The Subscription Fee is paid in advance for consecutive monthly periods of use of the Application.
- The day of the month, which will be the day of commencement of use of the Application under the Full Package and the Guardian's Package, is determined on the day of posting of the first payment and ends on the date that corresponds to the initial day on which he began this period, and if there was no such day in the following month - on the last day of the month.
- Payment of the Subscription Fee can be made by:
- transfer
- payment by debit or credit card
- Internet payment system.
- By choosing a credit or debit card as a method of payment of the Subscription Fee, the User simultaneously agrees to automatically charge the credit card or bank account for all fees due during the relevant period of use of the Application under the Full Package or the Guardian's Package. At the same time, the User agrees to the Operator's use of third-party intermediaries in the payment process, as well as disclosure of transaction data to them.
- If a credit or debit card is selected as the method of payment of the Subscription Fee, the fee for each subsequent month will be charged automatically, until the User declares his/her desire to cancel the Full Package or the Guardian Package. Such cancellation should be notified to the e-mail address [****] up to 7 days before the beginning of the new billing period.
- If you choose an online payment system operator, you acknowledge and agree to its terms of service available at [****].
- Withdrawal from the Account agreement
- The User, who is a Consumer who has concluded the Agreement, may withdraw from the Agreement within 14 days from the conclusion of the Agreement for the operation of the Account without indicating reasons. In order to exercise the right to withdraw from the Agreement, the User should provide the Operator with a statement of withdrawal from the Agreement. The statement of withdrawal from the Agreement may be submitted, among others, using the form attached as Appendix No. 1 to the Regulations or by any other unambiguous statement. In order to meet the deadline for submission of the statement of withdrawal from the Agreement, it is sufficient to send it before the deadline.
- Intellectual property
- The author's economic rights related to the Application and the author's economic rights to the images and content used within it are the exclusive property of the Operator.
- The Operator grants the User a free, revocable, non-exclusive license, geographically limited to the territory of the Republic of Poland and the EU member states, to use the Application in accordance with its purpose under the Terms of Use. For this purpose, the User may install, run, display and store the Application on a mobile device.
- It is prohibited to copy, distribute or disclose any part of the Application by any means, including but not limited to automatic or non-automatic "scraping".
- The User may not use the Application and the content within it for any other purposes without first obtaining the Operator's documentary consent. In particular, the User shall not have the right to:
- Reproduce, modify, adapt, distribute, publicly present and distribute the Application without prior express consent of the Operator;
- decompile and perform reverse engineering with respect to the Application, except as specified by applicable regulations;
- extracting or attempting to extract (in particular, using any data extraction robots or other similar types of tools used to collect data) a significant portion of the data posted on the Application.
- Disclaimers and Exclusions
- The application was developed to present information, to the extent permitted by generally applicable laws and in an objective manner.
- The purpose of the Application and the Operator is not to promote any doctors, medical entities, medical products or medical devices, or entities that manufacture or distribute these products.
- The Operator reserves the right to publish sponsored content, including commercial information and advertising, to the extent permitted by law. Each time such content will be properly distinguished and marked in a way that does not raise any doubts as to its nature.
- Any commercial information contained in the Application does not constitute an offer within the meaning of the Civil Code and cannot be the basis for any claims against the Operator.
- The Operator shall not assume any liability in connection with the User's use of the Application and the information provided by the Application. The User acknowledges that all communications within the Application are presented solely based on the data and information that the Dedicated User or Guardian has entered into the Application.
- The Operator is not responsible for the effectiveness and results of the treatment methods used by Dedicated Users.
- The User acknowledges that the Application is only a tool intended to support and facilitate the User's compliance with the recommendations that the User has received from a physician and which the User has entered into the Application. The Operator shall not be responsible for the Dedicated User's health and well-being, as well as the deterioration of physical or mental well-being resulting from the use of the Application and the messages transmitted by it, especially through the Dedicated User Assistant service.
- The Dedicated User Assistant Service is not medical in nature and does not constitute psychological support for the Dedicated User, nor does it guarantee that the Dedicated User Assistant will be able to interact with the Dedicated User in a way that actually improves the Dedicated User's well-being.
- The Operator assumes no responsibility for the provision of medical data by the Dedicated User, no responsibility for the provision of medical data of the Dedicated User by the Caregiver, and no responsibility for the provision of medical data by other entities that came into possession of medical data as a result of the User's failure to comply with the provisions of the Terms and Conditions, in particular with regard to the prohibition of sharing the Account password with third parties.
- The Operator does not analyze, check or control to whom the Dedicated User provides Medical Data.
- The Operator shall not be liable for any unintended use of the Application, in particular for the use of the Application by a Dedicated User or a Guardian for diagnosis.
- Users are responsible for the truthfulness and legality of the content they publish within the Application.
- The Operator reserves the right not to post or remove content published by Users within the Application, in the event that the User posts content that violates the rules of social coexistence, decency, provisions of generally applicable law or the provisions of the Regulations.
- If any of the provisions of these Regulations would lead to a limitation of the Consumer's rights under mandatory provisions of law, the application of which in relation to the Consumer cannot be limited or excluded - in relation to the User who is a Consumer these provisions of the Regulations do not apply.
- The User is fully responsible for his/her actions or omissions within the Application.
- The Operator's liability to Users who are not Consumers is limited only to willful misconduct, up to the amount received by the Operator from that User under the event in connection with which the Operator's liability arose. With respect to these entities, the Operator's liability for lost profits is also excluded.
- To the extent not regulated in these Regulations, the provisions of generally applicable law shall apply, including the Law on Provision of Electronic Services and the Law on Consumer Rights.
- Complaints
- Complaints regarding the Application should be submitted to the e-mail address: [***].
- Complaints are processed within 14 days of receipt of the application.
- If the complaint procedure fails to produce the result expected by the Consumer, the User who is a Consumer may use, among other things:
- Assistance from the relevant European Consumer Center belonging to the network of European Consumer Centers (ECC-Net). The Centers inform Consumers about their rights and help solve individual problems related to cross-border transactions. The assistance of the Consumer Centers is, as a rule, free of charge. A directory of country-specific Centers can be found at: http://www.konsument.gov.pl/pl/eck-w-europie.html;
- Online Dispute Resolution (ODR) platform, available at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=E;
- mediation conducted by the locally competent Provincial Inspectorate of Trade Inspection, to which a request for mediation should be submitted. As a rule, the proceedings are free of charge. The list of Inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595;
- assistance of the locally competent permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which a request for consideration of the case before the amicable court should be submitted. - free assistance from the city or county consumer ombudsman.
- Personal information
- The administrator of Users' personal data is the Operator.
- Personal data is processed in accordance with the Operator's privacy policy available at: [***].
- Termination of the Agreement and amendment of the Regulations
- The User may terminate the Agreement for the use of the Account at any time by sending the relevant statement to the Operator at [***] or by using the relevant function in the Application.
- In the case of violation of the provisions of the Regulations by the User, the Operator may temporarily restrict the User from using the Application, in particular the functions related to the Account, and will call on the User to remove the violation within 7 days under pain of termination of the Agreement for the provision of Account Services.
- In case of repeated violation of the Terms and Conditions or failure to correct the violation within 7 days of receiving the summons, the Operator may terminate the Agreement with immediate effect and for this purpose will delete the User's Account.
- The Operator reserves the right to change the Terms and Conditions only for important reasons. An important reason is understood as the necessity to change the Terms and Conditions caused by:
- adaptation of the Application to legal regulations affecting the Services provided through it;
- Improving the security of the Services provided;
- Change in the functionality of the Application;
- Improving the operation of the Application;
- Improving the quality of the Services provided;
- change in the cost of maintaining the Application.
- The Operator will inform the User about the planned changes to the Terms and Conditions by sending an e-mail to the address assigned to the Account at least 7 days before the changes take effect. If the User does not object to the planned changes by the time they take effect, he is deemed to have accepted the changes.
- If the User does not accept the planned changes, the User should delete the Account. The deletion of the User's Account is the same as the termination of the contract for the provision of the service of maintaining an individual Account for the User.
